I wanted to know if I can pursue a lawsuit. - [ ] My family
- [ ] My family and I walked in to Famous Footwear store. We we looking at shoes for my daughter. We tried different shoes, when I was at the check out the lady at the counter told me to wait and she walked some where. She came back and ask me about the same shoe but in size 5 that a box was missing. I asked her what that had to do with me trying to pay for some shoes. (They were some girl Nike shoes, and brown boots and sandals for my husband) She said there was two boxes of size 5 and she only had one box. She asked me were did I put them or have them at? (this happen in the front counter in front of other family wishing to check out). We walked to we're the shoes were at and she continue accusing. I told her that we were trying 2 different sizes to see what size fits better to my daughter. She keeps saying she had 2 boxes more of size 5. I told her I honestly don't know how many boxes of shoes she had we only checked and tried a pair of sport shoes and boots to purchase for my daughter, which the ones I picked are two pairs of size 6 that are in the counter. The police was there at the store 30 minutes prior me being at the register. Police officers walked closer to us and that's when I asked the manager do you think I stole the box ? I told her before she continue to accuse us of stealing to let manager aware of this, and she replied I'm the manager! At that moment one of the police officer repeated that she stated she had two boxes of size 5. I reply with okay I understand we tried different sizes. I told the officer in that moment that we did not even come in with a diaper bag or any bags and have not left the store. The police asked me if there was anything under my daughter which she was in a car seat . The police officer checked around the car seat, and asked my husband to help get my 4 month old out of the car seat so he can see that there was nothing under her. She looked at me and continue to tell me that there is one box missing and that we were the last ones to try them. I told her yes we tried some shoes and I have put the rest back and the ones we have picked are at the counter were she was going to check us out. She continue to accuse us and one officer asked me if I had anything in my pockets I pulled out my phone, cash, debit card and a gas receipt I had. She accused my husband of leaving the store, then i told the police officer that my husband has not left the store at all and to check cameras. She said she was, and one officer followed her. I called my boss to give me advice on how to take this false accusation (people were staring at us, I felt very humiliated). Meanwhile they check cameras and had the other officer wait with us. My boss arrived and I was explaining what was going on. The police officer came out with manager and manager pointed at the shoes and explain that I went to another aisle and they both walked to that aisle. The officer called me asked me to go with him and told me that the manager stated that I had left the same shoe size 5 on top of a box not in the correct spot and told me that i was not having appropriate behavioral act. I told him I had tried these boots and the ones next to those on my daughter, and that I had picked one of them which are in the check out counter and the other size that did not fit, I brought it back and forgot to put the other shoe back accidentally when placing the other boot back and asked if that's was consider stealing? The manager continue to say that she had counted 2 shoe boxes and we were the last ones to try them out. She said my husband had went outside and police officer ask to search my car, I said perfect go ahead I don't understand why you have to check my daughters cars seat for a whole medium size shoe box, which obviously don't fit in a baby car seat, and see no reason to check my car when clearly cameras show neither of us have left the store. I told my husband to give him the keys for him to search my car. I repeated to officer that I … read more
