Thank you for the reply. The statute of limitations that exists today is not the one that is relevant. You need the statute of limitations that was in effect at the time the crime was allegedly committed.

Over the years, we have learned much more about sexual offenses than we used to know, especially the fact that many victims are reluctant to come forward until years after they were assaulted. So as time has gone on, statutes of limitations have been lengthened.

From what I have found, in 1991 the statute of limitations for a Pennsylvania rape was only 5 years. So she would be time-barred from being able to bring criminal charges against you at this time unless any exceptions applied, such as if you have been living outside of the state.

What I'm saying is that if you spent 5 years in Pennsylvania after this alleged incident and she had a case once, she does not have one anymore.

As for threats from her husband, you never mentioned that in your initial question. No matter who he works for, he has no right to harass and threaten you. Blocking him -- for that matter having nothing further to do with either of them -- is what you should do. He can keep calling and calling you, but don't rise to the bait and release the block. If he has threatened to come to Texas and harm you, you can contact your police and the FBI and try to have him charged.

Texas may tell you you'd have to get charges pressed in Pennsylvania if that's where he's making the calls from, but your officers may still be willing to contact them for you and to tell them to back off and stop threatening and harassing you. Sometimes they will step in like that when they feel it appropriate. Even though they have no jurisdiction out of state, it would be enough to make a reasonable person think twice.

If you were only there for a total of 2 years after the incident, then you're not out of the woods and she can still prosecute. That doesn't mean either of them have the right to harass and threaten you for something that may or may not have happened in 1991. You can still report them to the authorities.

But what it does mean is that there is all the more reason not to say anything further to either one of them, because anything you say can be used against you if charges are filed. Keep in mind that although the case may still technically be charged, it is not a strong case for the prosecution, as her failure to come forward for 26 years doesn't give the DA much to work with. They may be unwilling to take the matter on.

If you find yourself contacted by the authorities with regard to the alleged rape, do not agree to discuss anything with the police. Just tell them that you have nothing to say to them until you have talked to your lawyer and then go find someone local to consult with.

I'm very sorry you spoke to her and admitted that you even had sex. If you hadn't admitted that much, the state would have had to prove you even ever slept together, which all these years later they would not have been able to do if you didn't take the stand. Now you've admitted that much, which is why you should say nothing further to anyone about this incident apart from the lawyer whom you, hopefully, won't have to hire.

Rape is the most serious of those charges. For lesser crimes, I believe the statute of limitations back then would have been two years. But if you were ever convicted of the rape, a jury would never reach the assault, as it would be a lesser included offense and not really a separate charge.

Although Texas is a one-party consent state when it comes to audio recordings, Pennsylvania requires the consent of both parties for the recording to be admissible in a Pennsylvania case.

If she taped you and told you it was being recorded and that's on the tape, then the tape recording would be admissible potentially in either state and you have admitted sleeping with her.

You would still have a consent defense.

Cases like this are always he said/she said cases that come down to the credibility of the complainant.
