I am sorry to hear about this situation. Under Va. Code 18.2-51, this would be a Class 6 Felony. For Class 6 felonies, punishment is a a term of imprisonment of not less than one year nor more than five years, or in the discretion of the jury or the court trying the case without a jury, confinement in jail for not more than 12 months and a fine of not more than $2,500, either or both.
As such, one may be looking at imprisonment of at least a year. If there is no criminal history and the wound was minor, then the Court is likely to suspend some of the term, but it depends on the Judge and there is no way to predict.
