A prosecutor has until the statute of limitations runs out to file charges for an offense. After that it would be too old to be prosecuted.

In Indiana the criminal statute of limitations is 2 years for a misdemeanor and 5 for most felonies. Some felonies, such as murder, have no statutes of limitations and can be prosecuted at any time. Sex offenses can be prosecuted until the victim is 31
