It really depends more on what actually occurred (the DA is less likely to be able to find any "penalty enhancements" - things that will increase your sentence), but I couldn't tell you one way or the other whether or not you would be facing jail time (the penalty is certainly there, and I would take this seriously - hiring a criminal defense attorney is worthwhile, not just to represent you in the matter to hopefully reduce the charges, but also to try to minimize the impact of any conviction on your record).
