(a) A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another.(a-1) For the purposes of this section, a premises licensed or permitted under the Alcoholic Beverage Code is a public place.(b) It is a defense to prosecution under this section that the alcohol or other substance was administered for therapeutic purposes and as a part of the person's professional medical treatment by a licensed physician.(c) Except as provided by Subsection (e), an offense under this section is a Class C misdemeanor.(d) An offense under this section is not a lesser included offense under Section 49.04.(e) An offense under this section committed by a person younger than 21 years of age is punishable in the same manner as if the minor committed an offense to which Section 106.071, Alcoholic Beverage Code, applies.____ Public intoxication in Texas is only a Class C misdemeanor. It is punishable only with a civil fine. It's the criminal equivalent of a traffic infraction and while there would be a record of your conviction if you pled guilty to this, that record doesn't go any higher than the local court level. By that I mean, there's a copy of this filed with the court, but it should not show up on a state or federal background check.According to Sec. 12.03(c) of the Texas penal code, a conviction on a class C misdemeanor doesn't impose any kind of criminal or legal liability on the offender. So it is not in the state or Federal criminal data base and you wouldn't have to disclose it as a crime that you committed. Even if you are standing on private property, if you can be seen by the public while there and while intoxicated, you could potentially be charged with public intoxication. It doesn't matter if it's your property or your family's property or anyone else's property. You were clearly where the public could see you and report you. HOWEVER, where you would appear to have a good case is that you had to be so drunk as to be a danger to yourself or others. And if all you were doing outside was praying and meditating, then you presented no danger to anyone. Since this offense does not involve any jail time, and your worst risk is a fine, you could go to court and plead not guilty to the charge and take it to trial if you so wished. It would be wise, however, to have a lawyer for best results if you want a trial. Otherwise, you'd be held to the same standards as a lawyer during the course of your trial, which could be problematic when it comes to presenting evidence.

But every element of the offense must be proved beyond a reasonable doubt for you to be convicted of this crime. Here are some cases involving public intoxication that were appealed in Alabama.
