If a county jail tell a female " you cant get out on work release because we do not have a female jailer in the evenings to check you back in " but the men can get work release because there is a male jailer in the evening, is that not discrimination.

Yes, indeed it is, and the prison should be made to do something rectify the situation. The defendant needs to bring that to the attention of his lawyer and to involve an organization such as the American Civil Liberties Union. If the female can't get work release, she may at least have a successful civil rights suit.
