Hola. Dentro de pocos días tengo corte, soy acusado de shoplifting por un valor de 34 dolares, lamentablemente voy a representarme yo mismo, mi record criminal es totalmente limipo, he leído acerca de casos donde programas de diversión son una opcion,
quisiera saber como preguntar al juez, o si debo de hablar con el fiscal, o que debo.de hacer para poder acceder al programa de diversion, y también quisiera preguntar si debo de decir que soy culpable o si debo de decir que no soy culpable

When you go to court and are before the judge, you need to plead "not guilty." A not guilty plea is the only plea that will allow you to negotiate with the judge and the prosecutor.

You may also be eligible for a free lawyer. So after you plead not guilty, you can tell the judge that you do not have money to pay for an attorney and ask him to appoint a free lawyer for your case. If the judge will give you a lawyer, your lawyer can try to get you a diversión program or some other program that will give you an opportunity to keep this criminal conviction off of your record. If you are not eligible for a free lawyer, after you plead not guilty you can ask the prosecutor and the judge for a diversion program.

Es mi primera vez en corte por lo que entenderá que estoy algo nervioso, definitivamente no calificó para un abogado publico, por lo que me representare yo mismo,
Cuando el juez me llama, el lee mis derechos, el lee la sentencia máxima, me pregunta si soy culpable o no culpable, cuando me declaró no culpable, el siguiente paso es preguntar si soy elegible para un programa de diversion? O el siguiente paso es dar mi versión de lo que paso el día del arresto. O en que momento exacto debo de preguntar por el programa de diversion

You can call the prosecutor's office, ask to talk to the prosecutor in charge of the case against you and then ask him if he will consider a diversion program. If the prosecutor says yes, you can tell that to the court on your court date.

Prosecutors do not like to negotiate with defendants who don't have lawyers. So the prosecutor may not want to talk to you. If you can't talk to him before court, then you have to plead not guilty before the judge and then ask the court for a diversion program. Make sure you ask for an interpreter if you need one.

If you can get such a program, the court will then tell you what to do. If the court and the prosecutor will not give you a diversion program, then I would urge you just to adjourn the case and come back with a lawyer.
