Theft constitutes a Class III felony in Nebraska when the value of the property involved is more than $1,500. Neb. Rev. Stat. § 28-518(1). In Nebraska, a Class III felony is punishable by imprisonment for a minimum term of one year and a maximum term of 20 years, or a fine of up to $25,000, or both. § 28-105. However, the statute does not require any minimum mandatory sentence, which is a good thing. That means the judge has options. Ultimately, even if you make a deal with the prosecutor, it still has to get approval from the court. While it is possible to go to prison for even a first offense, it depends on the facts and circumstances, and there are things a prosecutor is going to look at. You definitely have things that work in your favor.

First, they're going to look at your criminal history, and you don't have any. You're much more likely to get a second chance with no record and a first offense. Second, your level of remorse and cooperation. I don't know if you're looking to plead guilty to this or not, but you come across as contrite even in how you wrote this question, as if you acknowledge you made a mistake. Third, you have the ability to pay back the money in full - which is great. Restitution is always a big part of any theft charge. Fourth, they're going to look at you as a person. So, "letters of recommendation" so to speak from friends, a pastor, former co-workers, etc. talking about what a good person you are, etc. are very beneficial. Lastly, if the money was taken because of a drug or alcohol problem, they'll want to know that you're in counseling and getting treatment.

If you can show these things, I think you have a very good chance of getting probation. Never a guarantee of course, but a good chance.
