I had a federal criminal background check run when I started

Customer Question

I had a federal criminal background check run when I started working at this job. Today, I was asked to come into a program manager's office. He asked me if there was a felony out on me. I said "no". His secretary had just had lunch with a lady who works for the feds and stated to the secretary that a felony was on my record that someone else had missed. The secretary said you are not supposed to know. Well guess what, I don't know. I have retired from the state of Missouri (Department of Corrections). I have a speeding ticket in Gower Missouri. Wouldn't I have to be arrested or something to have a felony on my record?

Hi - my name is ***** ***** I'm a Criminal Law litigation attorney. Thanks for your question. I'll be glad to assist.
If you had a felony conviction on your record, you certainly would have been arrested tried/entered a plea and then sentenced, etc. Thus, if none of these occurred, you certainly should have serious questions about this allegation.
It could be possible that there is a felony warrant outstanding, but that would only be for your arrest.....not a conviction. Thus, it sounds like someone got their information confused......or the person simply doesn't have accurate information.
