I am over the age of 18 and i sent a picture of weed in the lap of "someone". I told her I got it for an old man. Her mom takes her phone and sees the picture and gets her boyfriend to call his buddy that is a sheriff. They were trying to get me on delinquency of a minor, but her daughter I would say wouldn't lie about it because we never talked about drugs or anything like that. she then says, I have proof you distribute marijuana. Even to one man it is illegal. I have all your email and text correspondences including all pictures. Your a grown man / find someone else to manipulate. It looks like you have a choice to make, not dalton. i hope your mother improves. at least i see that you have somewhat of an importance of family. if things go back before you talked to my daughter. I wont pursue it then. This is my last communication with you. I do not have a criminal record, i never have been in trouble. 1. Is this blackmail? 2. Can i get in trouble for sending a picture of weed that doesn't even have me in it? 3. I admit that I get it for an old man, but I don't buy or sell it. The old man asked if i knew someone and I told him yes, and I connected the two. I never had it in possession or sold it. I dont even smoke it! 4. Is this probable cause to get my records like she said?

I live in Ohio. The main reason she is doing this is because I am Christian and she is Jewish, so her mom hates me.

The picture was on a different messaging app. I didnt say this was drugs, i got this for anyone. Also over text i said i got it for for an old man, i never said what i got for him.... It was over thr phone where i talked to the daughter about anything. So wouldnt that mean it would be lack of evidence?

Hello,

I was talking to this female that was 17 yrs old and everything was fine. Her mother met me and she accepted everything. She then began to resent the fact that I was Christian and they are Jewish and her daughter "17 yr old" started to look into Christianity and hated me for this and tried to get us to stop talking multiple times.

(legal advice part)

I sent the daughter of a picture of marijuana someones lap. This was on the messenger KiK. I didn't say anything about it. But we talked on the phone afterwards and I did tell her I got it for an old man. Her mother took away her phone and seen this picture and the daughter figured being honest would be the best thing. Her mother ended up recording the conversation about her telling her mom that I got it for an old man. Next day, she told her daughter she doesn't want her seeing me anymore, but her daughter ended up seeing me anyway.

That night I will type you the text message.

Daughter and My Convo:

Daughter: Omfg my mom had Declan call his old ballpark sheriff commander buddy and my moms talking to him about the pot picture and the fact i admitted you sell to one guy and now shes talking about delinquency of minor. Im so so sorry im so embarrassed.

Me: Cant you just lie about it?

Daughter: She had her phone on record.

Me: With you talking ? or with you and i? Cause Im confused I dont sell or do drugs.

Daughter: She just said I have to go give a statement tomorrow and she cant take me so the major is.

me: So I could get in big trouble?

My questions:

1. Is this Probable Cause for police to call my carrier and attain for pictures, text, and etc.?

2. Does she really have all my correspondences and pictures?

3. Is this Black mail?

4. How long can she hold this over my head?

5. What does she really have on me?

6. Lastly, is this delinquency of a minor? and if this is distribution can I just pay the fee$150 and tell her mom that she has nothing on me?

7. She says she has all this information and pictures, wouldn't that be illegal for her to have that information?

I understand that the answer is stop talking to this girl. But her mom is crazy and I dont trust that she will let this go. She is crazy, I have text from her daughter saying her mom has hit her two little siblings, recently her other daughter called 241 on her and told them she hit her in the eye and she stayed at a friends house for a week. She has a charge for selling herion from 8 years ago. She had her kids taken away from her. But is a controlling manipulative person. Lastly, she cheats the IRS and makes 60,000 or more and gets foodstamps. But since she has a friend that's a cop, I feel like they will take her side.

And she says she has all my information like people who I talk to on my phone...People who wouldnt be on her daughter phone.

The only thing her daughter would have is what I told her on the phone which is (I got it for an old man)

I dont have anything in my house etc... I want to make this clear, I do not sell or do drugs.

As for how long the state would have to charge you with a crime in Ohio: 6 years for a felony, two for a misdmeanor.

Giving the weed to the man would be a misdemeanor. It has a maximum possible penalty of a fine of $150, but it would give you a criminal record. So you'd probably want to resolve it with some other way to keep your record clean. Regardless, once you were charged, she'd lose her hold over you.

I have already told you several times that if the daughter is going to testify against you you can potentially be charged with the marijuana offense.

Here's the statute for contributing to the delinquency of a child in Ohio. I don't think the elements of the crime are made out without a lot of stretching.

The mother is right. If you sent the photo along with admissions that you provided marijuana to one man, that is evidence that you trafficked in marijuana. It is enough so that the police would likely be able to get a search warrant to check out your premises and/or to charge you with a crime. The photo by itself doesn't prove a thing but in conjunction with your texts explaining the photo it does, and the texts would not be considered hearsay because it would be an exception to the hearsay laws, an admission against your interest.

It's not blackmail for a parent to tell you that she doesn't want her daughter dealing with someone who's involved with drugs and that she will report your crime to the police. On the other hand, even if you procure marijuana and give it to someone else without profiting from the transaction, under the law that's considered a sale.

You would have a defense to the charge if you were arrested -- that is, that you were not a seller but just an agent of the buyer doing something for him that is not what you'd ever normally do only because he pressed you into it. But whether that defense would be successful would depend on the facts and circumstances of the cases.

So, to recap: yes you can be in potential trouble. Even if you have a successful defense to the distributing charges, you can be charged in the first place and what you did and whether you ever so much as touched the drugs you photographed would be a question of fact for a jury to determine.

Whether you wish to leave her daughter alone is your call. But if you call her bluff, she's got cards she can play.

Unlikely. But it may be probable cause for them to search your home and for that matter, your phone, to check for contraband or evidence of further sales.

There's no way I would be able to know what she really has, but she likely has access to whatever her daughter has.

No

She would have until the statute of limitations runs out on the crime alleged. I don't know what state you are in so I can't tell you how many years that will be. It's conceivable that your girlfriend will achieve the age of majority before the statute runs.

5. What does she really have on me?

She has what your daughter has, and her daughter is willing to talk to the police.
