Under Maryland law (Md. Code Ann., Health -- General § 18-601.1), it is a misdemeanor offense - punishable by a fine of up to $2,500 and/or three years in prison - for a person who has HIV and "knowingly transfers or attempts to transfer" the virus to another person.
