If you were simply trying to remove the female from your house to prevent her from breaking anything else, then I would opine that the likelihood of you actually getting any more time in jail is minimal. Although a person is not allowed to physically come in contact with another person unless they are defending themselves, in this situation it likely was justified to prevent further damages.

If you have already been arraigned for the charge and been given a pretrial court date, then the DA will review the case and should have an offer for you to plead guilty at the next hearing date.

Having been a former Public Defender and represented clients in a hundred or more cases like this, I can tell you that once the facts come out, the prosecutor will realize that she was the aggressor and could even decide to dismiss the charges due to this. At the worst, I would opine that you may be placed on probation for some short period of time, maybe 6 months or a year for the offense with no other consequences.

That is assuming that you aren't going to hire an attorney to fight the charge if they refuse to dismiss it upon further investigation. If you decide to fight it, then at the next pretrial, your attorney would request a trial date, typically several months off. Then he would work on the DA over the next few months leading up to the trial to either get the charge amended down or dismissed based on the facts of the incident.

If your attorney can't negotiate a reduced charge or a dismissal, then there would be a formal trial where the state would have to prove that you assaulted her without an affirmative defense to doing so. Then a judge or jury would decide if you were guilty and fix the penalty.
