Criminal trespassing is a misdemeanor in Georgia, and typically unless a defendant has a warrant history and/or prior convictions or lives out of town so that the courts are worried he will disappear and not make his court date, he should be released on his own recognizance once he sees the judge. If he comes into court as a prisoner he should be appointed an attorney who can make an argument for his release.

Generally, though facts and circumstances can change the picture, this the kind of an offense will not yield a jail sentence, particularly if it's a first arrest, so there would be little reason to keep him in.

If you are thinking about bailing him out, you may want to wait until the arraignment when he sees the judge. That way no bail may be necessary.
