Car was involved in an accident but parked next to a curb.

Car was involved in an accident but parked next to a curb. Individual was at payphone across street calling for a towtruck. Cops arrive much later and are looking at car, male WALKS up to them and says that they are calling for a towtruck, they eventually arrest him for DUI. Can he beat it or should he plea bargain for a Dry/Reckless?(can they prove he was driving?)
