In order to assist you I will need to know what the charge is. In other words, what is the alleged crime? Thank you.

Possession of a control substance

The statute of limitations for the charge you have identified is 3 years. That merely means that the State must file formal charges within 3 years of the alleged crime, not necessarily that you go to trial that soon. If you have not been formally charged, then it appears that the State may only have 1 more year to do so.
