Resolved Question:

If a foreign national is convicted of a felony and then deported, what is the crime being committed if the person returns under a false identity. And what is the crime being committed if one is involved in helping the felon as a function of harbouring such a person.
Does the severity of the crime change from NY, FL or NJ? Or is it a federal statute?

Illegal Re-Entry After Deportation which is a federal crime punishable by up to 10 years in prison. A person assisting them could be guilty of being an accessory to that crime and/or Misprison of a Felon which carries up to 3 years in prison.

Being a federal crime it is the same in every state.
