It is a Class D felony, punishable by up to six years in jail and/or a $10,000 fine. It is a good idea for someone charged with such an offense to hire a lawyer or apply for the public defender, because a lawyer can try to negotiate the best plea possible. Since it is a first offense, it may be possible to get probation, and/or to try to get a plea deal to a lesser offense. An attorney may also be able to get deferred adjudication, which means that if the person complies with all the terms set by the court for a certain period of time, the case will be dismissed and will keep a conviction off of his or her record.
