Debbie was a busy bee! She always tried to get things done

Resolved Question:

Debbie was a busy bee! She always tried to get things done at lunch time, but that meant she had to hurry because she only had one hour. So at lunch, she was speeding home and talking on her cell phone while driving. Yikes! She didn't see a light turn red and she ran through the intersection hitting a little boy on a bike. The boy later died at the hospital. Debbie told the police she was hurrying to get home. After the incident, she did scurry home and found her neighbor in her backyard going through her trash! Debbie snuck up behind her and smacked her in the head with a golf club! Debbie doesn't tolerate trespassing! Her neighbor ended up seriously injured. What are the elements of a crime and do they apply to Debbie?

Thanks for the chance to assist on this matter. I am an attorney with over 12 years experience in criminal law.

She is guilty of negligent homicide (she was negligent is talking on the phone while driving and that negligence led to the death of another.

She is also guilty of aggravated assault (striking another with the golf club without his consent)
