I allegedly committed a 4th degree crime on 06/12/09. I may have received a ticket at the time, but I don't have recollection. The indictment was made on 10/14/09, which is over 120 days after the alleged offense. Is this grounds for dismissal under the 6th Amendment or § 3161. Time limits and exclusions? I have another question with regards XXXXX XXXXX case, but will add it in my response.

3161 deals with speedy trial. That has to do with the amount of time to go to trial after indictment. What you are thinking about is the statute of limitations.
