if there is pending rape set for trial and the defendant wife

Resolved Question:

if there is pending rape set for trial and the defendant wife comes across some evidence that can prove the victim has lied or had other motives like obtaining legal status in the us. and is seriously abussing a child and doing other unlawful activies.. but the defendant knows nothing of this information. can the wife come forward with this info without the fear of being charged with witness tampering

Hi Jacustomer,

If you are the wife of the defendant and have found evidence that would potentially help your husband, go to your husband's lawyer and speak to him and show him what you found. He'll be able to investigate this and if it all checks out and is helpful, he will know when and how to use it.

It's witness tampering if you show it to the victim or any of the witnesses in an effort to influence their testimony. Talk to your husband's lawyer first, and you'll be okay.
