My husband was in accident 04/04/09 looked as if he just plowed…

It is happening in Utah. Since my husband was killed on Oct. 9th., I have also been charged $700. for a car that was not in pieces not an eye sore, but was unregistered for a couple of months. They came and took pictures of it one month to the day Nov. 9, 09. sending me notices in both my husband and my name. The one notice that told me I had to be in court i did not receive until after court date in fact i think it came the same day the fine came in my name only. I just paid it, it has been hard enough to function on normal everyday things I was with my husband for 26 years. The shooting of my husband was witnessed by my daughter, oldest son and myself. Which is a long story in itself.

I'm at the point I do not know who to trust, as Saint George UT is mostly mormons and we are not.

They have changed my husbands court date appearence two or three times since his death are well aware he is not alive, my husband told the officer and other person who served her the paper for her to be in court that he was no longer alive and they said she still has to be in court or will be issued a warrant for her arrest.

I'm sorry but I don't trust the attorneys in this town. Is there a way to file the motion myself. I really do not want my daughter to have to go to court - We started an investigation because of how she was handled the night of my husbands death. A male officer after tackling her bruising her and getting her all wet from the grass wanted to stay in the room while she changed, when she asked for a female officer they said none was available. She threw her phone at him to distract him and close her door to change. The report the General Attorney's office made did not even match interviews with officers or my family regarding the death of my husband. This town is very close and cover their own.

Yes he is deceased he was my husband, the night he was shot by a policeman everything was done. Then my family was treated like criminals, really. I was with my husband for 26 years he did not have a criminal background- he was a good guy who the day before his car accident was awarded workers comp. for life in dec 07 fell off ladder came down head first and did some major damage to his right shoulder and after surgery the doctor told him he would not be able to do construction he installed hvac he never regained strength in his arm, and he had a bad back he was 48 and did construction all his life and loved it he was very skilled, he was one of those guys who had to stay busy. Well after the car accident he was not the same, memory loss, anxiety could not drive, could not remember what some of his tools were used for could not handle to many people at once talking in a room, sensitive to light. was mixing dreams with reality hard time sleeping.

The night he was shot he thought someone killed me, he called a friend she took it as he killed me and called 911, I have recordings of the call up until he was shot, all written reports all recorded interviews of the two police officers who came to my house that night and were ready to walk away after talking to me and realizing he had head injury and dealing with the issues, I was fine did not seem concern told them there was no guns or weapons in the house I had teenagers - they said okay and were going to walk away not wanting to escalate the problem. Then my husband walked out with a pellet rifle that did not even work the police panick took cover between two vehicles, my husband did not say a word to them never took cover - police officers had plenty of cover within two minutes they shot him, even tho i was screaming it was not real, my daughter and son were both there and seen it. Both my son and I thought the police officer was going to tackle him he shot one time I was told later by the er doctor he died instantly. However after he was shot I was not aloud to go near him. My daughter who of course is going to be upset was yelling and crying and was calling her best friend when a police officer tackled her, bruising her and kept harassing her for her phone my thoughts they thought she had it recorded on her phone. They were telling me to use my phone to call someone had no problem with my son and his phone. After she was tackled she was wet from the sprinklers she wanted to change her clothes a officer followed her in the house she asked for a female the male officer told her none were available he was assigned to her? He wanted her to change infront of him, said she could not shut the door to change. She had to throw her phone at him to distract him then slammed her door so she could change.

I started an investigation regarding how she was treated that night, no surprise never heard back from them.

It has been one issue after another with the city of saint george and the police believe me there was cover up done that night. Live interviews with officers do not even match final report.

But yes the paper given to my daughter states criminal action prosecuted. It is the same date I received in my husband name for his car accident. Stupid I know, your opinion was like mine how do you prosecute someone deceased? I'm telling you they do some major covering up in this area its a known fact. My feeling they want on record my husband has a criminal background, or they feel if they continue to knit pick me I will not start a suit against them well it didnt work I'm pissed, I feel as if I just woke up from a bad dream, the past months since my husband was shot have been hell on me. I am locked in with two businesses in this area or maybe I would have just sold my house and moved but I can't I dont have the money, everyday I'm remined of my husband being shot in our driveway and so are my kids.

I know I need to find a good attorney to look at everything regarding the shooting, the attorney general office said I have one year to file and suit and not to use a local attorney, citizens around here have pulled me aside some I dont even know telling to stand up and do something, things need to change around here - but its not easy when u have lost the person u mosted depended on and have no relatives in the area and three kids who also have pain, and a business you are just trying to keep a float.

there is more to that case, but i really need help i do not want my daughter to have to go to court she has been very mis treated by the police force around here. When she was 16 a boy hit her in the face with a beer can bruising the side of her face and breaking a tooth, she was trying to tell him not to drink and drive. We reported, I ater weeks of me calling everyday to see what was going to be done as I had to change my daughters classes around because she would see the kid in school and have panick attacks, was told the kid was going to be charged they just had to catch up to the kid. (my daughter graduated 1/2 year early. I found about two months later they did nothing to that kid and he later raped his mother, yeah he had serious drinking problems.

Brought that up after my husband shooting when they sent two officers to talk to my daughter regarding my complaint on how she was treated by the one officer that night was later told oh yeah something fell through the cracks and the officer who was suppose to serve the teenager with papers didn't but would be disaplined for it. RIGHT, like a believe that one. Just like the investigation on officer that night no response to that either. Yet I have paid $700.00 fine for just having a unregistered car in my driveway. Now they want my daughter in court Aug 3. SO YEAH I"M PISSED NOW - were not some family full of criminals we are a normal family my husband and i have no criminal backgrounds - I had a speeding ticket maybe 4 years or 5 years ago.

My husband yes was with a pain management, for his pain ater his accident I kept his pills at my work because he could not do it because of short term memory loss could not remember when he took pills - October we were moving offices from one location to another and I accidently through his pills away. It was 3 weeks worth so his doctor said just have a police report filled out and I will refill, so I called and reported on a Wed. Thurs. my son drove my husband to the station to get a copy of the report and they told him it would not be ready until the following week. I was pissed when my husband told me this was about 3 or 4 in the afternoon and his doctor is closed on Friday, my husband told me it was okay, I called the dr's office with police report record number but they said it was the law in utah they needed hard copy. So therefore my husband who has been on pain meds for shoulder and back, and now had head injury was put out of pain meds for three days yes that made everything too hard for him to handle.

I'm sorry but I am still having trouble with everything they have done?

They charged him with reckless driving before he died but because of his state of health, and memory loss when he showed up in court and pleaded not guilty they set a date and did assign him a public defender, however I called him and he has not called me back.

I have learned after being charged $700.00 for having a car in my driveway, and paying a attorney from here $3000, who resulted in no help at all.

Was told after the death of my husband that an internal investigation would be done against what happened to my daughter only to once again have nothing done. Just another slap in the face same feeling as when after the shooting we were told we should go for counseling, when I felt my kids and I were at a breaking point about two weeks after the shooting I go i was told to go to police station and was led down a long hallway behind closed doors and was told the police offer who shot my husband was in counseling but we did not qualify for free counseling because my husband was violent or abusive to me or holding me against my will, but they wanted me to have a pamphlet telling me of the grieving process. Personally they have pissed me off and slapped me for the last time. I'm ready to stand my ground and tell them all where to go.

Let me get this right the shooting of my husband was the biggest most talked about event for this town, newspaper, radio news, and because the newspaper printed my name more than once just about every where I went I was asked oh that was your husband that was shot. I felt like I stayed in a state of shock for months, so I know everyone person, police officer court personel is well aware of the fact he was shot. They printed our address, and there must have been at least 50 offical personel either police officers, investigators from three different cities at my house that night and again the following morning, my husband was the only Craig Steiner in this town.

So am I correct in saying that serving my daughter that subpoena is in fact harassment. Because she told there were two people who came to serve her that paper and one was infact a police officer. Them doing this knowing dam well they can not bring charges against my husband. Does this make any sense, are they not digging themselves even deaper making it only obvious they are guilty.

There is no will, the house we have probably might have about 15,000 equity maybe who knows in this market. Since Dec. 07 when injured in a work injury he was unable to work. Day before car accident was awarded workers comp for life they paid up to the day. He was awarded Disability from Social Security and were waiting for the first payment when he died. The last two years he was alive, I was able to work, do all the details needed for workers comp, file for Disability get all the paperwork done for that, care for my three children and care and love my husband who after his car accident would take a walk and get lost - my three kids and I would go and search for him, but still I was able to keep it together - even when he was at his worst with his injury he gave me comfort and strength as long as I had him by myside at night I had his comfort and feeling of protection that together we could still deal with anything life threw are way, I thought all the big battles were over and we were now going to be able to concentrate fully on just helping him recover. And in a blinks eye it was gone - everytime I drive up to my house I look at where he was shot and still walk in the house expecting him wanting him to be here. He is what kept me grounded, people tell me he was lucky to have me, most couples never make it through when one has the type of accidents my husband had - but I always felt like I was the lucky one, on the most stressful days all it took was smile and his arms around me and the stress just melted away.

I know I have about one week to pull this together as my daughter is suppose to start college in Cedar City about 1 hour from here, she deserves to be able to concentrate on school - without feeling like she is being singled out and harrassed. Her father was her hero also.

Still reviewing law firms - Because my anger and disgust with how city officials around here seem to think they are above the law, it sickens me and I have stepped down from work because the only thing I seem to be able to focus on is how unfairly and cruel my family has been treated - when they shot my husband, it was as if they tore my heart in soul in half leaving half of me for them to slowly torture.

How can they get away with doing something like this knowing it was illegal to carry through with a case on a deceased person.

I'm so pissed off it this does not make it obvious they have been harassing and what feels like torture to me knowing they were wrong shooting my husband who I loved more than my own life, leaving me feeling like an empty shell -

Now that I have leveled off my kids leveled off and stable , stopped my daughter from having to go to court and have given up my part ownership in one company so I can focus more on finding the right attorney and taking steps that need to be done. My anger and real feelings of how everything that took place that night is all I can think of now. Take into thought I'm the type of person who just can't let go when pieces do not fit together.

From start to end nothing was handled correctly. First ems who arrived statement reads Pt. was found lying face up, one officer had a CPR in progress; another officer was helping the pt breathe via bag valve mask. (I remember this the vision of watching my husbands stomach expand like a huge balloon.)

He then states he started to breathe for the pt, guessing that the pt had a GSW to the head because of the blood on scene. Pt had an estimated 2000 cc of blood loss around his head, pt was not breathing on his own. He alerted his partner to update the medics that there was a probable GSW to the head. K.P. came to the pt and started to hook the pt up to the monitor to check for a heart rhythm. K also helped me get the airway equipment ready, officer bagged the pt while I was getting the equipment ready to intubate to the pt. Medics arrived on scene while I was trying to intubate the pt. A.T. took a look with me to try, A.T. did try but was unsuccessful so I put in a King Airway tube. K.P. was successful in getting an IV. Zac worked on controlling the scene, watching the monitor and trying to gather more information. We tried to assess and see where the entry and exit wounds were on the pt. and thought that the entry was on the right side and exited on the left side, at the hospital they confirmed differently. If this was true wouldn't the force of the shot make him fall facing the left? The direction the officers say he was facing as he was suppose to be pointing the gun directly at an officer.

My husband turned to the right when he heard my daughter yell dad, the last image she has in her mind is watching the life leave his eyes as he dropped to the ground, facing to the right the side where my daughter was standing. Also the officer shot when my daughter and son were also in the street not more than 25 feet from him.

They also never stated who they were, they never said they were with the SGPD, they just yelled drop the gun.

Do I have the right to ask for the pictures of my husbands autopsy? If I do will it show pictures of his complete body.

We were refrained from going to the hospital at least 45 min after they took my husband, was actually told we could be arrested if we tried to leave the scene. It was not until a neighbor yelled out and stunned me telling me it was my right to go to the hospital to be with my husband. (She also works for social services and was given a written warning the following day for her actions - stating her actions were working against the police not with them.)

I was never allowed to touch or even go in the room at the hospital, where my husband was - The ER Doctor said he did die instantly - but yet I received the er bill and there is a charge for a blood infusion?

I really need to know more of what my rights are until I find an attorney who will stand up against this city.

I have the right to all pictures, photos, videos that was taken that night? Including the ones at they may have taken at the hospital.

Another strange thing in report they reported my husband had two 100 miligram morphine pills in his pocket. He was prescribed 5 miligram morphines maybe two times through his pain management doctor. However both times it should be documented in his file with doctor he did not like the way morphine made him feel, and requested both times with doctor that he prefered to go back to percocet 10 and deal with the pain instead of being put on morphine.

Two days before he was shot I did report that his pain pills were either lost or thrown away by me by mistake when moving company from one building to another. His medical report will also show we did control his pain properly, in the past 4 years I can't think of one time he requested additional medication because he ran out. In fact I do remember one time about 2 years ago I think when he was on Loratabs he called and said they were not working and we took the remainder of the prescription of Loratabs into the dr. office so he would write him a prescription for percocet.

St. George police was responsible for taking him completely off meds because they said it would take a few days to have a report completed for him. Is it common for a police station to take that long for a report? I mean taking someone who was with a pain mangement on a regular basis and check ups completely off there meds was dangerous in itself. Thank you and will leave a bonus upon your reply

APPEALS PROCESS (what a joke)

Pursuant to St. George City Ordinance 1.12B-1(A), any person adversely affected by any decision made in the exercise of the provisions of this chapter may file a petition for review of the decision or order by the district courth within thirty (30) days after the decision is rendered.

In order to appeal an Administrative Code Enforcement decision the following steps must be taken.

1. File a Petition or Complaint for Judicial Review with the district court. THE COURT DOES NOT SUPPLY JUCICIAL REVIEW FORMS, THEY MAY BE OBTAINED THROUGH PRIVATE LEGAL COUNSEL.

2. Pay the court a $155.00 filing fee with petition or complaint.

3. Within one hundred twenty (120) days after the petition, the party petitioning for appeal shall request a copy of the record of the proceedings, including transcripts of hearings when necessary. THE ATTORNEY I WENT TO FIRST FOR MY HUSBAND AND PAID $3000.00 I SENT HIM A COPY OF THIS BEFORE THE 30 DAYS AND HE TOLD ME AT THAT TIME TO START AN APPEAL WOULD NOW COST MORE AND I BELIEVE HE QUOTED ME $300 BUT CAN NOT BE CERTAIN BECAUSE I JUST WASN'T THINKING AT THE TIME, AND GOOD CHANCE I WOULD STILL END UP PAYING THE $710.00

Could I still file with the district court for a review - everyone i now talk to thinks this was an outrageous amount to pay for a car in my driveway unregistered for 4 months. Was not an eye sore was not torn down and in parts - was a 1993 Toyota MR2 - 2 dr coupe with low profile wheels.

They did send a notice of violation Dated Dec. 28th, informing me to have violations cleared up by Jan. 11th, and then one dated on 1/13/10, and to be honest I'm not sure of exact date I moved the car to a friend for storage but I know it was at least by 1/15/10.

Both notices have both mine and my husbands name on it.

Failure to comply by 1/11/10 will result in the assessment of fines ranging from $25.00 to $50.00 per day, plus administrative costs, beginning on 1/12/10.

What I realize now is that I was suppose to request an inspection, and obtain a certificate of compliance from a code enforcement officer. A certificate of compliance must be obtained by 01/11/10.

So because I did not request for inspection even tho I took care of the problem they started charging me maximum amount. I was not notified of date of hearing until after the hearing - I guess I just find it very cold and ruthless that they would bother me about something as small as an unregistered car in my driveway after one of their officers shot and killed my husband, they couldn't even let me morn without hasseling me about something so stupid.

It doesn't matter just pisses me off they would worry about something so petty after one of their officers killed my husband and turning my families life upside down that they would get any satisfaction from hurting and upsetting me even more..

Two questions:

1 - how long does it seem reasonable for a attorney to contact you regarding a case. July 15th sent in case evaluation form after contacting them once a week for three they did as for me to send them copies of everything I had. It is now over a week since they received all files - dont want to be pushy but I would just like to know?

My daughter also signed up for student housing a this apartment place, was unaware that she actually signed a contract in June - they told her the only way to guarantee her a spot was to have it turned in with deposit before they filled up.

The place was not what she expected and when I went to pay her fees for the first semister was a bit concerned.

Students sign a housing application & Lease - three students to an apartment, when my daughter went to look at them in June they showed a nice model apartment nicely painted - black leather couch - ,

Told her she had to sign this application & Lease and pay 300.00 deposit before they could save her a spot, 50 non refundable normal, but tenancy shall begin on Aug. 23, 2010 and terminate on April 30, 2011.

Today was the first day you could pick up a key to your place - well the place was dirty - and lets just say I did not find anything in the apartment excellent condition.

If your late on a payment they charge $40.00 the first day, and $35.00 dollars a day until account is current.

The part I am really concerned about is where it staters Tenants as it may pertain in this tenancy and this agreement. By this agreement each Tenant grants a power of attorney to each other Tenant to bind all tenants as it pertains to this agreement, addendums, notices, and pleadings which relate to this tenancy, including the obility to accept service of process and give notice to owner.

I was wondering if it was possible or allowed to pay you a fee and what the fee would be and fax a copy of this contract for your review - they knew I surprised a contract was signed and really did not want to make a copy to give me. Been out of touch for a while - Just found out that if I do not file a letter of claim by Oct. 10, one year from the date my husband was shot I lose all rights and ability to ever start a case.

Tomorrow I have an appointement with attorney general office to get copies of pictures and videos I never received.

I realized that I had to remove my personal feelings regarding this entire situation the only way to get to the bottom of what is truly the truth or corruption here in St. George with the police.

When I decided to look at this enitre situation without any personal feelings but start looking at it as a business perspective - for example when I took on AT&T when working for Matrix corp. in California which was bought out by AMP Corportation - my skills of digging deep and looking at a situation from all views and getting down to the facts and focusing only on important issues not emotional issues is when I discovered some really disturbing information.

#1 found out if I do not file a letter of claim by Oct 10, 2010 I lose all rights to start a wrongful death action against the st. george police of shooting my husband.

#2 - i NEED to know what my federal rights are now that I found out my family and I were recorded without being told we were being recorded both when taken in seperate room individualy for questioning and was recorded as well as being recorded in the waiting room where my kids and i were sitting waiting as a family in a waiting room to give our individual statements. All recordings of us was done without our permission. All recordings with officers involved were told they were being recorded and could stop at any time and could leave if they did not want to continue. We were not given that same right, I would not have given permission for this as I was still in shock at this time. Is it not ILLEGAL to record someone without their knowledge.

Most recent law firm I contacted turned my down stating "A judge will take an officers point of view over anything if he felt he was in danger he has the right to shoot and kill - case closed?

If this is so why have judge will side no matter what with the police officer

38 pictures were taken of my husband in the ER room they took him too. This was the hospital that did not even do the autospy on him. I know deep down something is being covered up. I'm beginning to think he was shot in his neck or head and that is why all the blood was where his head was not his side or back but his head.

If infact a police officer of less than a year has the right to make a decision to shoot and kill someone no matter what the situation is then I think the citizens here in St. George are aware of this as one city worker has already said they feel st. george has too many officers most who have very little training and that if the city would take more time training they would need less officers. How can a Rookie of less than a year experience have the right to decide to shoot and kill when it was obvious he just did not have the experience to handle the situation properly. Do law officers have to follow any FEDERAL guide lines -

Sorry this is late but any help on how to handle things when I go into get copies of pictures and videos of the scene can they really make me sit there and go through each item with them letting them know what I do and what I don't want. Seems that would take longer than to just make me a full set of all videos/cds/dvds of what was taken. But at this point I can and will do this I am no longer afraid of them - I will find what is being hidden but need to know if they have the right to record us without notice or informing of us they did this just happened to catch it in a small papragraph on one of the written reports.

Is not a federal law that a person is notified when they are being recorded in such situations. The officers were told of their rights that their interveiws were being recorded a a criminal investigation. Have no idea of what was said when we were being recorded as a family.

Attorney who waisted almost two months of my time told me they declined because a Judge would take only the officers point of few - If he felt he was in danger he has the right to shoot. Does not matter if he panicked, or tried no no attempt to negotiate in any way

We were never told we were going to be recorded in either of the rooms. It was at a sherriff office.

I have tried to find an aggressive lawyer, just doesn't seem that easy here to find one. have contacted several now. I have less than one month left.

I will be going to two other attorneys today also, and asking for all 38 photos taken of my husband that night at local hospital before he was sent for autopsy.

I will contact you later today with the wording on loan papers, I had to work long hours or the publishing co would have folded which would have meant the printing co I started would have folded also. I'm really trying to do all I am able to do its hard when I have no family here to help with anything and to make it look like I am fine so my kids do not fall apart again - hoping one of the attorney can file both then letter of claim and complaint filed. Today I had a meeting with an attorney.
He did bring up to me that each of my children would need to sign a separate retainer agreement and that my husbands, mother and siblings could also have a claim and if so would need to sign a retainer agreement too.

He seemed to agree that what was done to my daughter and the fact that they subpeona her is probably grounds for abuse of process, excessive force against her that night also - "We would all like an explaination as to why they felt their was a need to tackle her or why an officer would even think he had the right to tell her she had to change her clothes with him standing in the doorway."

Complaints have to be filed by Oct. 8th. He asked if I read the newspaper articles and I told him no my kids and their friends told me what it said and people were blogging about it I didn't care what others thought and I was not going to get into a media battle - It did not seem real to me that what had happened really happened I gave him a summary of what happened that night told him about the car accident his injuries and what our situation was, he stated the first thing that should be done was to get a copy of 911 call and radio transmissions - was surprised when I told him I already had it and copies of just about everything from that night.

Did tell him I was concerned him being located in St. George and he said he understood as it does get sticky for them also when such cases as this or cases against local physicans come their way - stated in most situations like this they file the claims out of their Salt Lake office.

His advice was to let the harassment issues go - as it would make us look better and not just out for money?

I know the issue with the fine for car and no registration was done legally to their so called codes and it was the date they came and took the picture that pissed me off the most two months to the date husband was shot.

Told him my husbands life was worth more to me than any amount the city would ever have but what happened was wrong.

He did say since St. George Police is covered by the City - who is protected as a government agency that there would be a cap as to what amount you can sue for.

Did not say what amount that cap was - told him losing my husband was like being torn in half and my husbands life and right to live was decided upon and taken in less than 1min and 45 sec. Every thing about that night was handled wrong resulting in a loss that to me and my children will never beforgotten and with or without him I will continue suit against the SGPD and would not let my daughter start a case until I file for my husbands rights as I will not let her be center of focus my family stands as one, that is how my husband and I lived our lives and that is how my children and I will stand.

He then stated they currently were representing someone else in a case against SGPD and city.

He then gave me a copy of his retainer told me to take it with me look it over, he would talk to his partners and for me to bring it back by Monday.

I hope this file is better - I do hope this attorney works out as my time is running out. I'm kinda upset with last attorney just kinda seemed like they were stringing me along. I have realized now that I'm starting to be able to focus again that the hard printed files I was given was as if the took all reports from the four different responding departments that showed up or were part of the investigation and shuffled them almost like you would a deck of cards. I know what happened, I know the officer who shot him should not be a police officer and the other officer that showed tried his best to cover up how quickly and unnecessary it was for this to happen. Both officers were close enough when my husband walked out they should have been able to tell instantly it was not a real rifle. And now that I took all copies that either had Saint George Police Station listed on top of the report or were copies of reports that were never signed there really is no questions at least from my point of view - I'm lucky I looked at very small versions of digital photos and paid attention to what folder they were listed in or yeah I'm sure I would have fallen completely apart.

I really do appreciate all the time you have put used on this for me. I'm the type of person who does not accept something if my gut instinct tells me something is wrong, especially when it was my husbands life - I will get wording on my deed - actually got to the modification approval two times each time we got to that final signing stage husband either started receiving workers comp.

When I went back to the attorney Generals office to get complete set of cd's including the ones that my husband was in, the copy I received this time also had photos of the night my husband was shot there were more than the first cd I received and this time they must have been copied at a higher resolution it always bothered me they would not let me get close to my husband that night not even at the hospital I was not allowed to enter the hospital room I was only allowed to look at him from the doorway and his head was at the other end. It never made sense to me why they put a neck brace on him that night if he was shot in left arm and chest.

Last night I decided to take another look at the photos because it now gets dark about the same time now and I just wanted to see. When i opened the photos I seen there was different angles taken of his hat so I enlarged them a bullet entered and exited his hat on the one side the hole is smaller with a thin line of blood on outside of hat - the other side is bigger and much more blood. His shirt they cut off him did not look like it had that much blood on it but they also rolled it up and put it in the middle of the blood where my husband was laying, so now I'm back to being confused - In my statement I did say I thought I heard two shots but everyone else including my kids and neighbor said they heard one. So how can this be? Being shot in the head would make more sense to me as he did die instantly. Also the cd that was blank was pictures of the officers in their uniform and gear of that night. The one who shot him was not wearing a taser, but the other officer was is it required for police offiers to have tasers? I have not said anything about this to my kids - I know it is going to become public when we make a complaint - I just didn't want to tell them until after Oct. 9 as it is my ungest birthday and just wanted him to have a normal birthday I will be taking him out of town.

I guess my question Is it required for officers to wear tasers?

Yes I did but I also said it was not real right after that - more than once - even told my husband to point at me so they would know it was not real. They also printed I said he did this so they would come shoot him - I never said that! When he came out he did not have the hand gun I saw when he came out of our bedroom, when I came home from the store - I asked him what he was doing with the fake gun he look at me like he was looking right through me and said your dead, i know your dead I called Tracy and told her your dead - he then walked back in our bedroom - thats when I text Tracy and said I don't know what Craig said to you but Im fine. I was about to go in our bedroom and find out why he thought that when I got a call from Tracy who had called 911 talked to the officer who was with her and he said they wanted to come and make sure I was okay I said fine - told my daughter who was home what had happened looked in my bedroom and my husband was laying down looked like he was sleeping so I went outside with my daughter and the officers showed up. talked to them for about 4 or 5 min explaining my husbands condition told them of his brain injury told them he took everything out of our bedroom and it was in a pile in the garage - they said they understood and was about to walk away not wanting to escalate the problem - when my husband walked out - 1 min 45 seconds later he was dead - his doctor also gave him sample packets of ambian sleeping pills wed - and had been without pain medication since wed - So yes I know I should have said no thats a rifle, but not real but to me when you say gun I think of hand gun not a rifle looking pellet gun - things happened so fast and I couldn't figure out why my husband was would not respond to me or think such things - I just found out what ambian does to people makes them hallucinate, sleep drive and sleep walk? When my daughter screamed stopped looked at that way and they shot when he was not following the cops they ran up our drive way which is like a hill my husband was walking down the street to where a field used to be when we moved here 10 years ago. It did surprise me he walked out with the pellet gun but I didn't panic another minute or even seconds and my daughter and I could have had it under control both officers were on the force less than a year and infact from what I hear now the one who shot him joined the force 2 months before this happened - why couldn't he shoot him in the leg he was close enough he could have tackled my husband as my husband was not even looking at him and the cop came from behind and shot him- still doesn't explain the whole thing is just messed up. all the blood was coming from around my husbands head.

Thank you, XXXXX XXXXX there is nothing anyone can say, It just angers me that the police here have no training they take a 4 or 6 month course given here in St. George and most of that is class room work, they are then given a gun - the officers interview is clear to me when he said he could not remember anything that was told to him, and all he could think of how he didn't want to be there - (then why is he a cop - what happens when he comes accross someone who really is dangerous) not to mention he said he could not recall looking to see where myself or my kids were at if anyone put anyone in danger it was him when he shot - I was very close to where my husband was standing. I know many people abuse pills - but there are still people like my husband who have no choice and had no choice his pain was real, one 5 min call to his doctor and a report should have been printed immediately its sad to think the last days of his life he had to spend them in extreme pain - and sick from withdraw only to be shot by those who were responsible. But we did share a special love for many years, that many never ever find. hopefully this attorney will help and some justice will be done as I'm not sure I received a complete autopsy report or the lingo they use. They parked their car about 4 or more houses down from our house - they actually went to the wrong house and decided to just walk to our house, but they did not have camera in cruiser.

Something is not right besides how quickly officer was to shoot there are to many things conflict in reports, autopsy and photos of scene my gut feeling is there was a shot to his head. OPINION: This 48 year olf white male, died as a result of a gunshot wound of the left arm and chest. Investigation indicates the decedent was shot by a police offier following an armed confrontation.

Wound on arm is on top side of arm just about in the middle between his shoulder and elbow. no bruising or anything on underneath part of his arm,

where the marks are on his hat the sketch of a person given with autopsy has Not good and two words that i can not make out on one side and ET blood and one word i can not read on opposite side same spots as where you can see blood on his hat.

Something else disturbing is how a Det.. of the Washington County Sheriffs office notes that when they arrived to the hospital to interview us the Dr. was in the quiet room was giving us the death notification he went to the trauma room where he met with SGPD Det. C. Trani and Deputy Medical Examiner D. Reid who was conducting and examination of the decedents body.

Seems to me an investigator from a different police department or agency should have been present during this examination, it was approx. 2 hours after shooting actually happened.

URGENT -

I was suppose to have meeting today with attorney at 2:00 to take in all signed retainers, including the one I was waiting for from my husbands oldest son in WY. and I was told at that time the attorney would go over everything line by line word for word how case would be handled. His last words to me last week after I turned copies over to him was lookes like I have alot of homework to do.

I called today 10:15 because my husband's oldest son wanted to be conferenced call as he is part of this case and wanted to hear what the attorney was planning to do.

When I called to ask about conference call was put on hold - was told by girl in office that attorney said he needed all signed retainers before he could go over the materials I left and rescheduled me for tomorrow - and said Oldest son could be conferenced in. My stomach is now in knots feeling I'm being given the run around what do you think PLEASE I have 4 days left

I do, just got back from meeting with attorney - He suggested we name both officers to be liable which also means SGPD will be held liable. Will be emailing me what the claim will state actions by noon tomorrow, papers will be filed thur. . He is going for wrongful death - survival action and is also filing claim on how daughter was handled that night.

He also told me to go to courts probate clerk as they are very good, and could tell me what has to be done instead of paying for attorney.
