We currently have a road easement that is 15 feet long that

Resolved Question:

We currently have a road easement that is 15 feet long that is someome property but, we have for access to our house. It is vacant landand the owner lives 45 miles away. For some reason he keeps turning in our dog to the human society for crossing the road and going to the neighbors to play with there dogs. They don't play on the easement they just use it to back and fourth between houses. If it is and easement for acess why can the dogs not use it?? We have now been called in by the property owner so many times they are going to start fineing us. Can this really be true??

I have no idea why he has a problem with your dog. You need to ask him. The other thing is if he lives that far away how does he know. Why are they saying they are going to start fining you. Have they given you a statute or ordinance that you are violating?

They haven't given us one but, the have given the neighbors one. They told us that after a certian amount of claims they start fineing you for there time to come out and check. But, everytime they have come out the dogs have been locked up in kennels. The neighbor says he doesn't care and just doesn't want the dogs on his property at all. And he will be comming out to check and make sure they are not crossing his property and if he see's them on there he will keep calling. I have no clue what to do.

The dogs are trespassing on his property but, it is a road easement!!!

They told us that after a certian amount of claims they start fineing you for there time to come out and check.

Ask the agency that told you or rather them that you would be fined to give you a copy of the ordinance that you are supposedly violating. They can't fine you for coming out.
