i am a non profit entity. recently i found out a volunteer

i am a non profit entity. recently i found out a volunteer has collected adoption fees for animals that are mine. i am act now rescue. this person, who has been fostering , has adopted out foster dogs and had the adoption fee, in the form of a check, made out to act. she then cashed the checks and kept the adoption fee without telling me. she ran it thru her bank and i had no knowledge of what was happening until i recently tried to collect an adoption fee and was told that they had paid the fee well over a month ago. i have had four fees stolen from me this way. what do i do?

Here you can have her charged criminally with breach of trust or you can sue her civilly in small claims court. The choice is yours. Usually the best way is to confront the person, allow them to make restitiution and then terminate their relationship with your organization.

the amount is over a thousand $ and she has been acting as a representitive of our organazation in order to collect the adoption fee. is this embezzelment

Yes it is embezzlement but it is usually charged as a breach of trust.
