Hello and thanks so much for choosing this forum to pose your important legal question. I will do my best to give you some honest and accurate guidance as I answer your question.

  1. I am a licensed attorney, and I will be glad to try and answer your question. I hope that the following information will be helpful to you, but please just write back if you have any follow-up questions or need clarification on anything after reviewing the following information. I hope that everything gets resolved appropriately in your situation.
  2. Under Arizona law, there is no statute for public urination per se, actually. However, public urination umbrellas many different criminal codes. Criminal littering, criminal nuisance, and disorderly conduct are a few of the transgressions. And if anything is fully exposed, then it falls into indecent exposure, too.
  3. The most common charge would be indecent exposure, pursuant to Arizona Revised Statutes § 13-1402. Assuming the situation does not rise to the felony level (exposure to a person under 15 years of age), it constitutes a class 1 misdemeanor. The penalty range is a maximum of six months confinement, pursuant to Arizona Revised Statutes §13-707, along with a fine of not more than $2,500, pursuant to Arizona Revised Statutes §13-802.
  4. A conviction is considered a criminal offense and will result in a permanent criminal record. I would urge you to retain criminal defense counsel, which is your best option for avoiding serving time through a negotiated plea bargain or, better yet, hopefully defending against the charge.

I hope that this information has been helpful to you. If we can be of any further assistance please free to use our service again. Best wishes for a successful outcome.

If my answer has been helpful to you, please click "ACCEPT" so that I may be paid. This is the only way that I will receive compensation for the work performed. Relist: I still need help.
Further information - I was handed 50 dollar ticket last night but have been told to attend court next Monday. Is this a fixed penalty and if so, why do I need to attend court - is this simply to pay fine? Can penalty be increased? Is the consequence of a fixed penalty any less severe?

Hello again and thanks for writing back. I will be glad to comment further.

Based on the additional information you have related, it sounds like you will likely be afforded the opportunity to enter a plea of guilty or nolo contendre (no contest) in exchange for disposing of the matter by paying a modest fine. This is often the way such minor matters are handled. Just keep in mind that it will still result in a criminal record, unless the charges are actually dismissed or you contest the case and receive an acquittal. It is still important to appear in court as ordered, as the failure to do so will likely result in the issuance of a bench warrant for your arrest.

I hope this is of some more help and that everything works out for you in this matter.

Take care and thanks again for using JustAnswer®.
