In the state of California, can a passenger of legal age be charged with drunk in public? The driver was sober and was told she was pulled over for stopping in a no parking zone. The officer then told the passenger to get out of the car and that he was being arrested for drunk in public. The driver was then told to move on.
In any state you can be charged with anything. Whether or not you may be found guilty is a different matter and that depends on the facts. Public intoxication is a feeble charge in most locales and I think that most Judges will toss out charges like that but, again, it depends on the facts. If the passenger cussed out the officer or made some sort of a scene then the Judge may find them guilty. It also depends on the Judge.
