VerifiedAt a sentencing, the Judge will usually hear testimony from the defendant himself as well as any family members who are their on his behalf. Normally, the Judge wants to hear some justification and see remorse, for the actions of the Defendant. Anything your son has done to correct the mistake he made, should be presented to the Judge at that time. Moreover, if a Pre-Sentence Investigation was done on your son, the Judge will read that and use it to help him make his decision. Since your son does not have any prior offenses, he should not be scoring any mandatory prison time. If that is the case, the Judge has the discretion, on his sentencing. The Judge most likely will sentence your son to a lengthy probationary sentence and order him to pay restitution to the victim.
