Under New York law, forcible touching is a Class A Misdemeanor. The gist of the offense that the prosecutor would have to prove is that he intentionally and for no legitimate purpose, grabbed, squeezed or pinched the sexual or other intimate parts of the victim for purpose of degrading/abusing the victim or gratifying his own desire. If he was convicted of the offenses, a Class A Misdemeanor has a maximum jail sentece of up to one year.
Endangering the welfare of a child is also a Class A Misdemeanor under New York law. There are two forms of this offense, one for parents, guardians, and others who have care and custody of children. The other form is for other persons, without the care or custody of the child. Section 260.10 of the New York Penal law states:
§ 260.10 Endangering the welfare of a child.
A person is guilty of endangering the welfare of a child when:
1. He knowingly acts in a manner likely to be injurious to the
physical, mental or moral welfare of a child less than seventeen years
old or directs or authorizes such child to engage in an occupation
involving a substantial risk of danger to his life or health; or
2. Being a parent, guardian or other person legally charged with the
care or custody of a child less than eighteen years old, he fails or
refuses to exercise reasonable diligence in the control of such child to
prevent him from becoming an "abused child," a "neglected child," a
"juvenile delinquent" or a "person in need of supervision," as those
terms are defined in articles ten, three and seven of the family court
act.
Endangering the welfare of a child is a class A misdemeanor.
In either type of endangering the welfare of a child, if he is convicted of this offense, a Class A Misdemeanor has a maximum jail sentece of up to one year.
It is quite possible that the prosecutor will offer a plea bargain of something less than a guilty plea to all three offenses. The offer may or may not include an agreement as to the sentence. Much will depend on your fiance's prior criminal record, if any.
