I was in an accident on November 30, 2022. Fortunately, I had collision coverage on my policy. After filing my claim, I made numerous phone calls and sent emails over the following 6+ weeks, asking Allstate to tow my car to a safe location (towing is a service offered as part of my collision coverage.) They asked me to select a collision center that is in their “network.” Twice, while speaking to a claims representative, I was told my car would be picked up and towed to a collision center I had selected from their network, but both times, Allstate failed to pick up my car or to even make sure they were accepting vehicles or how long it would take the collision center to pick up my car. As a matter of fact, when following up with the collision center, it sounds like Allstate never contacted them about the assignment. Long story short, over a month passed and my car had not been picked up and was still at the original location, near the scene of the accident.
I had been making it clear that the car needed to be moved, that it was not at a safe location. I asked them to tow my car to my Honda dealership which was just a few miles from my car. They agreed and I was told to follow up in a few days, giving them time to get it done. So, a couple days later I checked Allstate's website for the status of my car. My claims information was updated and now read as follows: “Our adjuster is working with Howdy Honda to begin the inspection process." Of course, this led me to believe my car had been picked up and was at the dealership.
Then around January 14-15, I get a message from Allstate, that they "can't find my car and don't know where it is!" The adjuster had been to the Honda dealership to assess the damage to my car, but when he arrived at the dealership, he discovered the car was not there. On Jan 16th, I was able to establish that my car never made it to the dealership as Allstate and I agreed. It was still at the original location, where I left it on November 30th. Finally, I called myself and found a collision center that had room on their lot and agreed to pick up my car. Allstate, apologizing for the confusion, assured me they would make the arrangements to have my car moved and stored at the collision center. The tow truck arrived on Jan 19th, but by that day, my car was gone. It was established that my car was stolen on January 17th.
Allstate failed to pick up my car and tow it to a safe location, in a reasonable amount of time after my repeated efforts urging Allstate to get it moved. I was not covered for theft. Clearly, my car would not have been stolen if it had not been for the claims agents’ carelessness and professional negligence to provide the service, a service that both party’s had verbally established (and can be proven, given the recorded conversations have been preserved). There was additional communication via email between myself and the representative, that states clearly, arranging for the tow was not something I needed to do. That, in fact, Allstate would take care of the details for getting my car moved.
There was a major breakdown in communication, failure to relay important information or honor verbal arrangements, stated or implied between my assigned claims representative and other Allstate associates servicing my claim. The information and emails were disorganized and confusing. I was not provided accurate or timely information and agreements were not honored. There had been an agreement, an understanding to provide services, making it their duty to follow through. My agent failed to keep track of details necessary to carry out his responsibilities and negligently breached his duty to provide even the smallest of care, resulting in the total loss of my car.
