Dear Infolawyer,Earlier you gave me advice on how to approach my issue with a school Can you elaborate on some of the ideas that you mentioned in connection with my case. Could you please call me at(###) ###-####any time till 11:30 PM today or tomorrow after 4 pm Eastern Time.Thank you for your call in advance.Sincerely,
ZI took classes online at Fullsail...
I took classes online at Fullsail University for a bachelor's degree. About halfway through my studies, I wanted to change my degree to another one that fit my schedule and abilities much better, but the university sent the federal student loan back to the lender by accident in this process.They didn't tell this one to me first. However, they asked me to pay for the remainder of 9 months' worth of classes from my own pocket. It's only when I started to ask around did an administrator admit - by accident in an e-mail - that they messed up with my loan which was the reason why I would have to cover the rest 9 months (9 classes) out of pocket. This pretty much rendered me unable to pay for the rest of my studies, so I quit without a degree. The best part only came after this: I made sure that there were no untied ends with the school. However, the school started sending me letters for almost 8-10 months. At first, I thought that it would be one of those "come back, we love you" kind of marketing materials, but once I opened one, I saw that it was actually from a debt collection agency. They wanted me to pay - for Fullsail University - around $16000 for classes that I didn't even register for. This would have been the full tuition for the remainder of my 9 months - the one that they sent the loan back to the lender by accident. So, I am thinking to myself: They want me to pay for something that I didn't even take? I started asking around at the university and it turns out that their online system registered me as an active student even though I wasn't one anymore. Once I was supposedly started to take those classes - which I didn't - I had a certain number of days to withdraw for a full refund of the $16000, which I didn't know about, since up till that point I had long been gone from the university and didn't have the intentions of going back... So, I opened one of those letters, debt collection letters, which also listed about $4000 for the cost of the collection, ending up in about $20000 in total together with the $16000 loan. I started talking to the school back and forth, and it was one of those "witch-hunt" - a type of situations when I was considered to be guilty and owe them money until I proved that I didn't. They gave me the run-around between the Financial Office, Admissions and another one I can't recall...If the university can mishandle loans, then it can demand the same loan from me;
if the university can misregister me and send a debt-collection agency to come after me, demanding the money value of the very same loans that they sent back to the lender by accident;
if the university can freely state that I took classes, which I had never taken from them and demand money for it, then what's next?Finally, they realized that they screwed up big time after I kept on asking questions from them. They were very open since they knew that they were right. Once I made them realize that they demanded money from me that derived from their administration of my loans and presence there, they cut out all communications with me. Finally, after about 3 weeks, their head-honcho in charge figured out that they messed up and sent me an e-mail, but not even admitting that they messed up and saying "sorry". Obviously, they couldn't be wrong... All the e-mail contained was a final request for a payment of about 600-something dollars. I paid it off right away before they could turn around and accuse me of owing to them more again. Now, this was all back in 2012 and I was so happy to not owe them anything that I didn't even think about turning to an attorney. However, the more I have been thinking about it, the more there is this idea in my mind that if a university can demand money, which was not owed to them, then why can't I turn it around and say: You know what? You tried to cheat my family out of money and take it away from my kids? If you can do it, then I can demand the same amount back from you, plus emotional pain and suffering. The question is: can I?These are some of the answers that you gave me back then...11 January 2017 03:49
You have a few options. Let me outline them. You can pursue a complaint in civil court. You may sue for losses suffered plus costs and interest. You can also file a complaint with the attorney general office. You can threaten these options before pursuing and use for leverage. local counsel can also get involved! A lawyer letter alone can often bring about a settlement as the other side realizes that you are serious and gets concerned about its risk and legal fees...

When you first responded to my question, it sounded like that you may have a good idea in terms of how to start the process...
I would like to know if you could tell me more about it or if you can be the person helping me to putting together that letter that you mentioned... "You can consider a complaint through several agencies and preparation tactics as well. "

A lawyer letter alone can often bring about a settlement as the other side realizes that you are serious and gets concerned about its risk and legal fees.You want to prepare your case by creating a time line starting from the earliest event. For each event, write down key details and witnesses and if there is a document that relates to it, save it and refer to it. This timeline can be very valuable in narrating your case and presenting it later in a concrete and specific way.You stand to recover not only your actual losses (compensatory damages) but also interest, costs and legal fees. on occasion special damages (punitive damages) are also available. Customer reply replied 4 months ago
you were the only lawyer who told me what you told me... the others didn't even come close... can you recommend somebody? Please.
Customer reply replied 4 months ago
I have the timeline that you mentioned...
I have the documents from the collection agency...
I have the letter in which they accidentally acknowledge that they messed up my loan...
...all I need is a person who can clarify what I can ask for... otherwise, I know what I would want to ask for...
Customer reply replied 4 months ago
How can I find a lawyer who would be good-enough to put together that letter that you mentioned?
You can prepare the timeline and retain local counsel to pursue and welcome to return and check with me on strategy or issues as they arise.
