Can I revoke a car purchase agreement that I made Nov. 27 and still have not been given possession of the car? I paid $3,000 down, so I want my down payment back in addition to release from the purchase contract.

Lawyer's Assistant: What state is this in? And how old is the car?

Texas. 2005 MINI Cooper S with 39,258 miles.

Lawyer's Assistant: Have you contacted the manufacturer?

I told the Wells Fargo representative who called me today. That is the finance group. I told him I would not pay the January payment if i didn't have the car by then and he put a note in my file. What would MINI Cooper have to do with this? It's a used car.

You should give notice to the seller that you are terminating the contract and request your deposit back. Under Texas law, the seller is required to find another buyer, and to return your deposit once the seller has a replacement buyer.
