RE: Termination of Medicare due to failure to pay...Occurred

Customer Question

RE: Termination of Medicare due to failure to pay...Occurred Sept 30, 2016.
JA: What state are you in? It matters because laws vary by location.
Customer: I am a California resident
JA: Has anything been filed or reported?
Customer: I received final notice stating payment must be recv'd by Sept 26th for $780.34. Spoke with Medicare agent (phone). He looked at my account and said, "You're fine, Mr. Gilmour. Just send the payment in the mail." This termination all transpired yesterday with letter from Social Security.
JA: Anything else you want the lawyer to know before I connect you?
Customer: It was a misunderstanding on my part due to failure of my insurance agent. She kept telling me my auto-debits were in place and my Medicare policy was in good order. She failed to tell me that because I am not collecting Social Security yet, that I must also pay a "penalty" to CMS until I start collecting Social Security. That's why there is this mixup.
