i had deposited a third party check in my bank account and the bank doesn't want to give it back to me because they say its fraud, how can i get it back?

Unfortunately, the bank is under no obligation to return a fraudulent check. In fact, they themselves could be liable if they were to return the check to you that they believed to be fraudulent. If there's some reason you need the check back perhaps you could provide that information to me and I could maybe offer suggestions on getting around that.
