Subcontractor has not completed work as contracted on one house

Customer Question

subcontractor has not completed work as contracted on one house and left second house 90% complete after learning he had been paid in full for both projects. Now hes trying to say I owe him money. Threatened to file lien on first house if I do not Pay. My records show without error he is in error. I helped him through weather delays here in SC by paying him steadily. Then had to finish house 2 on my own and he still has some work to finish on house 1. I Fired him Now he is threatening me with a lien. How should I handle this

You should file suit first against him for failure to perform his contract and breach of contract. Thus any claim by him would be a counterclaim and would probably be viewed by the court as retaliatory. This would allow a judge to review your proof that he has been paid and then you could add a fraud claim for his fraudulent demands.

You can either have the court order him to complete the work or refund the money paid to him for not completing the work.
