We Just moved in and the air conditioner quit, we called our home warranty people and they sent out there tech. when he finished looking at the unit he said the damage was caused by someone who tried to seal up the coil to hide water leak that caused the damage so they wont cover the unit. The tech said they did these things to get past escrow. In our mortgage papers the sellers said the unit was worn, It is an old unit but the insurance would have covered it if it failed for age. the sellers lied about the condition of the unit and I think that's fraud. Am I right and do I have recourse?

Only that they lived here prior to us moving in we were only here 3 days when we turned on the air and the only evidence was the tech eval after it burned
