A former renter of mine was called by a woman claiming that she needed my phone number and address so that I can be "served" to appear in court over a past credit card debt. When she left a message on my phone she referred to a claim number HI-125556 and left a phone number to call (1-XXX-XXX-XXXX). When I called to see what this was about I was routed to a Mr. Ernie Salas of B&L Litigation Group out of Newport Beach, California. He claimed that his firm was representing HSBC Ameritech regarding a past due amount on an old credit card in the amount in excess of $4900.00. And that I could go to court and have to pay additional attorney fees should I lose, that there would be a lein on my house, garnishment of income etc. He went on to say his firm was willing to settle for half the amount if we could come to agreement that day. I told him I needed to do some research because I was under the impression that the debt was part of a bankruptcy that I went through in 2006.
However when I referred to a credit report I pulled up on 11/8/2013 it has HSBC on it but the amount is much less then he claimed ($2700.). I informed him of this and he attempted to get me to pay half of that amount. I informed him that I couldn't afford that as the whole reason I filed bankruptcy 7 years ago is because I was becoming increasing disabiled. I am in fact on Social Security Disabiliy now and it is my understanding that those funds can not be garnished. He went on to threaten to lien my home. I informed him that the IRS already has a lien on it from 2007 so the likelyhood of his lien was not very threatening. I then called a "attorney hot line" and was told to offer to settle for .20 cent to the dollar amount. I did so but after several more threats he hung up on me. The next day he called again and said his firm would settle for $650.00 but only if we agreed today and I overnight the money gram or credit card info that day. I became suspicious and called HSBC they said that the credit card number was invalid (even though it is on my credit report) and that they further research the matter and get back to me in 10 to 14 business days The report also says "Account charged off. $2744.00 written off past due as of Aug 2010"
I'm disabiled and not very financially knowledgable so I'm not sure if I'm being Scamed or not. I imagine the "settlement" is fair if it is real and would come off my credit report but when I "googled" B&L Litigation Group there was nothing. My concern is their sense of urgency threatening me that if I don't pay today the deal goes away and I go to court for the full amount (which frankly I could never pay). Is this ligitamet or just a scam. Should I be concerned that I maybe severed and have to make arrangements to go to court or figure out a way to pay the $650.00. They are very aggressive with their calls and threats. The fact that they didn't even have the amount that my credit report reflected was "written off" was the first red flag. He claimed that a credit collections company hired his firm to go after me and the original amount that he quoted included "late fees, and interest"
HELP ME! The constant pressure to "settle" is stressing me out. I'm afraid to answer my door or take calls.
