I received a debt collection Summons and Complaint from a
I received a debt collection Summons and Complaint from a law firm representing Wells Fargo Bank, and answered this with denials or lack sufficient information... I then submitted a request for Production of Documents. I did not receive a reply. I then submitted a 2nd set of Requests for Production of Documents, 1st set of Requests for Interrogratories and 1st set of Requests for Admissions. I have not received a response and it has now been 16 days over the 30 days required to return these to me. I don't want to send another set of these in, or file a motion to compel. I would like to see about getting a motion to dismiss based on them "admitting too" the questions in the Admissions. Do I have to file a Motion to Compel? Can I file a Motion to Dismiss instead? Unfortunately, among the questions I asked on the Request for Admissions, I did not ask the specific question of, "Admit the Defendant does not owe the debt."; however, I did ask, "Admit the Plaintiff does not have a full account history from when the alleged account was opened."
