The easiest and by far fastest way to get this done is informally and personally. I would go and ask for your money in person on Monday. Because they have had favorable reviews, perhaps it was just a banking error. That sometimes does, in fact, happen. You will know for sure tomorrow. They should hopefully be apologetic and accommodating. If I were you, I would not take another check from them. Cash or cashiers check only. Or since you both bank at Chase, they can make an instant transfer right into your account. I am so sorry you have to be going through this at the holiday time of year. They should also reimburse you for your bank charges on account of the bounced check. If they do not take care of you properly, your only recourse will be to sue them in small claims court. While it is not an instant process, it is fairly fast as court systems go. Writing a bad check is a crime in NY state. I am hopeful and optimistic that you will be taken care of immediately tomorrow. The limits in small claims court are $5,000. Also, you may collect twice the amount of the bounced check up to $750 in NY State, plus your court fees and costs. These are the incentives to get them to pay. If they refuse, I would send them a certified demand letter giving them 10 days to make the check good, and then sue them in small claims court. I am optimistic (hopeful), however, that they will make good on their check tomorrow. I purchased a car mid August at a dealership in Venice, FL. They had let me leave with the vehicle and everything after I signed the contract thinking the vehicle was mine. Turns out the salesman lied to the bank about my work history, when I gave accurate information on my initial application. Well, he began harassing me about getting on my managers to lie to the bank.
