I just received a call from a "Legal Office" saying that I didn't repay a payday loan from 2007. I had till 5 oclock to answer or the charges will be sent to my County Sherrif's office and charges will be filed. They are saying that I could be charged with check fraud. Can they do that?

What this debt collector has done is against the law under Pennsylvania and Federal law. A collections agency is bound by the Fair Debt Collection Practices Act and Pennsylvania's Fair Credit Extension Uniformity Act to refrain from intimidation and threats of jail when trying to collect on a debt.

You can report the collection agency to the Federal Trade Commission and the Office of the Pennsylvania Attorney General.

We do not put people in jail in this country for failing to pay a civil debt.
