My question involves repossession laws...
My question involves repossession laws in Georgia. My husband had a motorcycle that was totaled in 2007. There is a police report stating this. Suddenly, after nearly 5 years, the finance company has gotten a repo order. We think they pursued this because there was a balance owed that wasn't fully paid off, but the motorcycle was totaled in the wreck and was towed away from the scene. My husband was taken by ambulance from the scene of the wreck and upon his release from the hospital left the country on military orders (he had the departure orders prior to the wreck). He never saw the remains of the motorcycle again. We have provided a copy of the police report to the finance company but we are suddenly being harassed by a repo company. They just woke us up again at 1 am demanding the motorcycle. They refuse to identify what company they work for, and refuse to stop coming to our home in the middle of the night. There are no identifying markings on their truck so we can't contact the owner of the company. What can we do to stop them from coming here. We have the police report but no one seems to want to acknowledge that.

I would two things:

1) file a complaint with the Federal Trade Commission -- the agency that enforces the Fair Debt Collection Practices Act -- for the harassment.

submit a copy of the police report

J.Hazelbaker :

2) call the police if a repo is attempted again. The repo agent is prohibited from breaching the peace. Coming a 1 AM after being informed the vehicle no longer exists and starting an argument is a breach of the peace. Provide the responding officer with a copy of your FTC complaint and the accident/police report.

A combination of the above should, ultimately, end the repo effort.
