Trying to settle my Mothers estate.
My mother passed away in 2007 leaving 5 children. She left a life interest to my brother with the stipulations that he will take care of the property and pay insurance and taxes. He and another sister were co-executors. There were three adult children living in the house at the time of my mothers death. They agreed to pay 400.00 dollars a month for rent. That said income was to be used for probate / lawyers fees when settling the estate. After discovering that they were selling many assets of my mothers estate I asked for a detailed summary of what was happening as I was one of the named beneficiaries. The year was 2010 when I enlisted a lawyer. Once that had happened my sister denounced herself as co-executor and continued to divide the remaining cash between the three siblings. She and my other sister passed in 2012 leaving my brother in the house by himself and the fiduciary duties as sole executor. Unfortunately he suffered from substance abuse and was incapable to handle these duties. In 2013-14 we discovered he was not fulfilling his life interest for the said property and was not keeping the property or insurance paid. A foreclosure of said property was going to happen and that is when my remaining sister and I stepped in to pay the back taxes on pretense that my brother would move out and we would sell the property that remained. We attempted several times to initiate this agreement but were met with verbal threats of him shooting or killing us. We had no other option at this time but to hire a lawyer and go to the Superior Court of Justice in Ontario. There it was ruled that he must supply us a full accounting of assets of estate and provide updates on a bi annually.
He never supplied us any updates. In November of this year he called me stating that the city has now started proceedings yet again to foreclose on the property. My sister and I met with him again at my mothers house to discuss the situation again. This is when we realized my brother had not been taking care of the residence. We refused to pay the taxes this time until he has moved. Again he threaten our lives and we were forced to leave. I had to call police and a 22 riffle was taken away from him and he was to appear in court. My brother has now passed. There is only my sister and I now left and emotionally drained from not only losing yet another sibling but having to deal with the estate.First of all we believe that the proceeds of the sale of the house should be ours to divide between the two of us.
We were not included in any liquidating of my mothers estate prior and feel that our share was not considered. So much has been hidden from us and liquidated without documentation and distributed to only the three siblings.What should my sister and I do as the grandchildren are now asking for their share.
