Is it worth suing a Boston pizza in burnaby? On Dec 30th
On Dec 30th 2021, in the evening, me and my family went to Boston pizza at station square. Our bill was just over $200. When it was time to pay, we gave the server 2 gift cards. Each gift card had $100. There is proof of this from the person that gifted us the gift cards. The server then scans one of the gift cards, and 20 seconds later, scans that same gift card and claims the second gift card is empty. (at the time, as claimed by the server, we thought 1 gift card went through and the other gift card was declined) we later come to a conclusion that the server kept 1 of the gift cards, and scanned the same gift card twice. The other gift card was never scanned that night. We have proof of this from 2 documents, one document was provided by the Boston pizza headquarters and that provides the activitys on the gift card used that night. On the document it shows that the gift card was used at 20:21:22, then swiped again at 20:21:43. We also received a document from the Boston pizza themselves regarding the gift card usage in the whole store that night. Within that time range, and that shows that the server never scanned the other gift card containing the $100. The only gift card being scanned was the same gift card that was already used. And obviously, it kept getting declined since the gift card was already empty. When this first happened while we were paying and the gift card was being declined, the manager came and tried and told us the same thing. He said that the gift was never loaded up. And so we accepted that explanation because we thought the person giving us the gift cards forgot to load the gift card. We then proceeded to pay the rest of the bill which was $110 approximately with a $50 gift card and the rest on credit card. I then contacted the person that gave us the gift card. He showed me proof of the receipt that showed the gift card was in fact loaded and a mistake was made by the Boston pizza. We then both contacted Boston pizza headquarters through email and none of the emails were responded to regarding this situation. About 4 emails were sent all together and one voice mail to their office. After calling the Boston pizza restaurant, the answer was to keep contacting the headquarters and keep bothering them until they answered. After many attempts to meet with their general manager they emailed me on Jan. 14th saying that they want to look more into this. And then on Jan 17th. They emailed me and said that the mistake was made the manager scanning the gift card and they agreed to pay back $125 payed out on 5 gift cards (so 5 gift cards having $25 on each). Which that statement is a lie because the manager didn't come until after there was a problem with the gift card claimed by the server. I have not picked up the gift cards yet… read more
