it certainly helpsHe was given 2 "N" letters already both asking him to leave in 25 days (Feb 28th)

One cites the safety of the tenants in the building as he fell asleep at night while cooking (he was intoxicated). The fire alarms went off and the fire department had to show up. It is alleged that the Fire Fighters had to "revive" him with oxygen although my son says none of that happens as he can remember. He has asked the fire department for a copy of their report in the event there is a mistake.the letter went on to say he put the other tenants at risk, etc, etc... but there was no actual fire...only smoke from the oven. I've also found out that the fire alarms are set often by many tenants due to them being so sensitive....my son actually disconnected one once because of this and was caught doing so which is also cited in the letter.also....he is being accused of not keeping the heat on his electric baseboard heating which (they say) caused a frozen pipe behind his bathtub making water freeze and unaccessible to 3 other units.....he has lived there for 4 years and this was never an issue before until now....can they make him pay for damages they say are his fault or do they need more proof? The building is very old (1980's)

can they evict him for causing the smoke alarm to go off and having the fire department there due to him being intoxicated?

having the fire department there is not proof enough?will the tenant board generally "side with" the landlord? One thing my son thinks is that his unit is very under charged and he is "GrandFathered" into this rent ($1000/month)....he was told by many super's that his rent should be closer to $1800/month but until he leaves they cannot change his rent.

my son is able to attend that meeting and defend himself correct? He can also have a lawyer with him if he chooses to?

I probably do but for now I'm good. I want to get the fire department reports first.

If the landlord brings action to the tenant board to ask for an eviction and the tenant board agrees with the landlord and the tenant is evicted how much notice would generally be given to the tenant to evict? Would he be expected to leave asap or is there a 30 day grace period? ALSO....can an appeal be filed by the tenant or the landlord if the decision by the tenant board is not liked by either party?

but if the board decides to evict how much time is given to the tenant to get out of the apartment? Is there a set amount of time or can it be that day even??

OK....Thx.....I was just curious if (on average) if there was a set amount of time normally provided to the tenant....i.e. 10 days or 30 days, etc...sounds to me like it could be any day and there is no "normal" amount of time given.
