A further question about my tenant who paid only partial…

Hi, a further question about my tenant who paid only partial rent this month.The reason he has not paid rent is that there was a major rainstorm and the basement leaked. We arranged to have it cleaned up immediately, but it has taken nearly four months to have the basement waterproofed and returned to normal. While this sounds long, there was so much rain at the time, this was the soonest we could have the repair done.We did have water removed several times as needed and pulled up the carpeting and wet drywall. This is an unfinished basement.On November 29th they sent a later saying they were expecting substantial abatement for not being able to use the basement. I said that since it was an unfinished basement, there would be no "substantial abatement", but that I would compensate them for the hassle when the work was done. I didn't want to agree to an amount at that time in case the work was further delayed.The next month is when they didn't pay full rent.My question, I no longer wish to provide any abatement since they withheld rent and have been very difficult about this. As of right now the work should be completed today, and they have until Jan 31st to pay the unpaid rent, or I can file to evict (I've already served the N4).Should I pay any abatement?Thanks
