I live in Calgary AB but my 95 year old mom lives in BC. She
I live in Calgary AB but my 95 year old mom lives in Langley BC. She is involved in a joint tenancy townhouse with my twin brother and her elderly brother who is 99 years old. I thought I would provide some background: They said it was not a gift. They were asked to leave the townhouse they truly enjoyed but relationship started to breakdown in a variety of wars with my brother from time they moved in in June 2020-tidal. My brother didn't want it to be “ a care home” as my uncle needed a permanent catheter placed in June 2021 and he didn't want to be their “nurse” or at their be on call. He constantly was controlling asking who they spoke too and giving them heck fir breaking the dishwasher, getting the Tv to not work etc. they often wanted some of their “items” fit. Storage and he said that “ junk” I don't want here in my house. They now live In another property they owned and my brother got his friend out of this premises so he could put my mom and uncle somewhere. It is one bedroom condo so my mom sleeps in the living room. My mom gated going there as a “ working condo building” . They are upset they have no control over their townhome now as my brother is the principal resident. In 2020 They sold their beautiful place in a seniors facility partly because of Covid as they gated being relegated to their room and felt they would live with my brother. Now that they are not able to live there, they want to know: what constitutes their ability to sever the joint tenancy. Why? They said you can “buy me out”…I said no mom, joint tenancy is “ right if survivorship”. She didn't know she couldn't ever sell or leave to someone else in her family. She has other children and this townhome is 1 million and bulk of her estate. More importantly she needs money to help her elderly brother. They are now looking for a senior home, expensive and really want to buy but so far no luck. Questions:1. Can they sever without telling my brother? The relationship with my brother is now strained and he hadn't been too kind since they moved out of townhome in October last year. 2. What grounds do they need to bring a severance to my brother? 3. Can they force him to sell so both my uncle and mom can get their money out because they say they want it. 4. How Can they leave to another individual of their choice their part of the townhouse.
