OK, the first thing to understand is that civil actions in matters regarding the death of a pet are very tough.  While many pet owners consider the animal to be part of the family, in fact the equivalent of a child, the law views pets as property only.  And generally speaking, if you sue someone for death of or damage to an animal, you're generally limited to the replacement value of the animal.

If you want to sue the vet for your fees to be returned, that's possible.  But you need evidence that the vet not only misdiagnosed, but was negligent in doing so on top of that.  You need to show that the level of care provided was sub-par, not just that the vet made the wrong diagnosis.

When you get the necropsy results back, take it to a lawyer to write a strong demand letter to the vet.  Vets hate bad reviews and bad publicity, it's still very much a word of mouth business.  The threat of a lawsuit might be enough to force a settlement.

Find a lawyer through the provincial Law Society's webpage at it's lawyer referral service, or try lexpert.ca to find a lawyer or paralegal in your area.  Remember what I said; veterinary malpractise suits often aren't worth pursuing financially.
