The Federal Court of Canada declared that quarantine hotels may be unconstitutional but have allowed this question to be considered at a later date so a final decision has not been made on this question yet. The FCC however, did deny the injunction application to stop the use of the quarantine hotels rule so for now, quarantine hotels are still a requirement for air travel under the Canadian Travel Restrictions. However, they are not for persons entering Canada by car.

The NB travel restrictions announced on April 23, 2021 are even stricter than the Federal travel restrictions.

I am checking now to see if there are any exceptions to the NB travel restrictions.

I have also been researching the mandatory orders made under New Brunswick's Emergency Measures Act and prior to the change on April 23, 2021, persons who have received permission from the Chief Medical Officers regarding exemptions to the travel restrictions should be able to have this permission honoured at the border. I am still looking for the post April 23, 2021 mandatory order and will reply shortly on this.

I have reviewed this order and it does not mention that permission given by the Chief Medical Officer for exemptions to the travel restrictions will be honoured retroactively.

Hopefully, there was be change to this today when the announcement is made as I think NB border officers also need clarification on this issue. Legally, unless the mandatory order states that permission given by the Chief Medical officer prior to April 23, 2021 for exemptions to the travel restrictions are no longer valid, the NB border officers should still honour this authorization unless it has an expiry date.

The only other option is to claim that your husband is a rotational worker because they do not have to stay in a hotel under the mandatory order.

Since the current mandatory order does not explicitly state that prior approval is now void, you can tell the NB border officers that this approval is still valid under the Order. However, the border officers may not agree as they have the final authority so the clarification today is important on this point for everyone or else you are not guaranteed entry without doing the hotel quarantine.
