Just to clarify the situation, you called the police because of an argument with your children?

And your worry is that your ex is going to try and do an emergency motion or order to change the agreement of custody?

If he does file an emergency order, he may try to do so with OR without notice. If he does it with notice you will be able to respond back to this notice explaining exactly what you told me.  If he does it without notice because he feels if you are served there would be immediate harm to the children BUT it has to be good enough reason for a judge to even decide that that can be done without notice.

You have evidence of the police report that you called and everything that you're explaining to me now.  Unfortunately, there is no way to stop him from doing this other than if you have a reasonable conversation with him.

This would mean he does not need to serve you with a notice of the urgent motion.

But there must be a good answer or reason as to why you shouldn't be put on notice before a judge decides.
