Good afternoon. Our family lives in Toronto and we planed to move to Vancouver area this summer. So on March 11 we came to Vancouver trying to buy a condo. On March 13, my family visited one condo Sam McCall was selling in West Vancouver, BC and we were interested in it. After communications on its costs, date of closing etc. we signed a Purchase and Sales Contract on March 14. We prepaired everything needed for this purchasing and planed to move to BC after my son finishes the school in June in Toronto. But in the late afternoon of June 7, my broker informed us suddenly the covenant requires that at least one occupant of the property be at least 55 years of age, so this condo is actually not Ok to sell to me and my wife (I am 40 and my wife is 36). He mentioned he just got this shocking news from Sam, and before this we never got any such information. So from March 14 to June 7, for nearly 3 month the seller's brokerfailed to do his job properly. He listed this condo with wrong information. It was so late to inform us this issue. This made our plan in a mess, and hurt my family's feeling so much, especially my kid because we have talked so much about fun of living in Vancouver. He also told all his friends and teachers he would welcome eveyone come to Vancouver and can stay with us in our beautiful new home! We also suffered a lot of loss including our flights, hotel, can rental, currency exchange etc.. So we want to see if we can get any good advice from you to see how we can handle this issue.
