I own a townhouse that's been split into a duplex with a studio apartment in the basement with a separate entrance and a shared ventilation system. The tenant in the basement came with the property when I purchased it and had no one living above him for a while. His lease from the previous owner transferred over to me and he had agreed to not smoking in the unit in writing on the lease. The new tenants who live upstairs have been complaining that there is a smell of smoke coming from the vents, to which he replied he did not smoke inside, but lit incense to help him sleep. The upstairs neighbours have also complained of loud music being played from his unit. He contends that they are screaming, yelling and banging on the floor, interfering with his right to reasonable enjoyment of the property. I am going to go inspect the unit and see if I can notice any signs of smoking, but I am fairly certain that the basement tenant is being difficult and creating problems as he has threatened me several times with withholding rent, and has used derisive and antagonistic insults at me. He has also refused entry once whenI had given him well over 24 hours notice. I am documenting the complaints and am notifying him and requesting him to cease the behaviour. I am concerned that his behaviour won't change and so I am wondering in the case that it doesn't if I would need to evict him, what kind of evidence would I need to increase the likelihood of the LTB accepting the eviction. He pays monthly rent, he has agreed to no smoking in the unit in the lease agreement. I had hired vent cleaners to come to the unit, giving him more than 24 hours notice, and 2 hours before they were scheduled to arrive, he told me that he would barricade the door and call the police if I attempted entry as he did not have to let me in due to his concerns with COVID, even though I assured him that the vent sanitizing company followed COVID protocols
